Art is a partner with the firm Hite, Fanning & Honeyman L.L.P. A seasoned litigator with over 35 years of experience, he practices principally in the areas of civil litigation and insurance coverage litigation. He is admitted to practice in Kansas state and federal courts, and the U.S. Court of Appeals for the 10th Circuit.

Art has been listed in Chambers U.S.A, an independent guide to leading business lawyers, and he has received an AV® Peer Review Rating in the distinguished legal directory, Martindale-Hubbell®.*

In his civil litigation practice, Art focuses on the defense of individuals and corporations in civil litigation. He has extensive court and jury trial experience from having tried a wide range of civil cases.  His representative experience includes: 

  • Preventing certification of multimillion-dollar class action against a major natural gas producer regarding interpretation of mineral deeds.
  • Obtaining summary judgment against $2 million lawsuit that alleged city breached contract to issue industrial revenue bonds; affirmed on appeal.
  • Serving on trial team for 17-week trial involving numerous environmental contamination claims, which culminated in defense verdict.
  • Representation of trustee in liquidation of stock brokerage reaching judgments or favorable settlements involving millions of dollars of claims.
  • Representation of State of Kansas in school finance litigation concerning claims for approximately half a billion dollars in spending.

Art also devotes a significant portion of his practice to representing insurers in insurance coverage litigation. Among his more significant work in this area, he has successfully:

  • Achieved decertification and dismissal of multimillion-dollar class action against insurance company regarding its payment of medical personal injury protection benefits under auto policies; affirmed on appeal.
  • Prevented certification of insurance agent class action in litigation filed in Texas federal court against insurance company by negotiating favorable settlement with putative class representative.
  • Achieved judgment in Texas federal court that insurer is obligated to defend class action filed against a client in Georgia federal court.
  • Achieved favorable settlement for insured in $2.5 million hail loss property damage lawsuit.

He is a member of the Wichita, Kansas and American Bar associations, the International Association of Defense Counsel (IADC), the Defense Research Institute (DRI) and the Kansas Association of Defense Counsel (KADC). He frequently authors material for and presents continuing legal education programs. Since 1990, Art has been an author for the insurance chapter featured in the Kansas Bar Association's (KBA) annual survey.

Art received his B.B.A. and his J.D., cum laude, from Washburn University. While in law school, he was a member of the Moot Court Council and a staff member of the Washburn University Law Journal. At the conclusion of law school, he was made a member of Phi Kappa Phi Fraternity based upon his academic achievements.

Kelly Rundell leads Wesley E. Brown American Inn of Court
Kelly Rundell has been elected president of the Wesley E. Brown Inn of Court for the 2017-2018 year. The Inn’s 100 members are selected through an application process. The membership is made up of Masters, Barristers and Associates, depending on the attorney’s experience. Kelly is a Master and has been a member of the Inn since its formation in 2008.
