Successful Appellate Attorneys

Our lawyers have extensive appellate experience in the Kansas Court of Appeals, Kansas Supreme Court and the United States Tenth Circuit Court of Appeals. Appellate practice is specialized and involves different skills and strategic considerations than other practices. On appeal, our attorneys move from developing and proving facts to interpreting the legal issues that determine the outcome of the case. A few (out of many) recent successes showcase the ability and talent of our appellate lawyers:

In 2019, HFH successfully represented its client in Law Co., Bldg, Assoc v. Law, before the Kansas Court of Appeals.  The decision reversed the district court’s interpretation of the calculation of an equity participation payment under a financing agreement for an office building development. 

In B.C.S. Holding, Inc. v. Lexington Insurance, Co., the firm obtained a judgment in favor of an insurance carrier, regarding an interpretation of the language of the policy.  In 2015, the Tenth Circuit affirmed the decision.

After the parties to a personal injury case settled their dispute, one of the parties tried to get out of the deal.  Our client wanted the settlement agreement of B.E. v. G.G.  to be enforced.   In 2018, HFH’s attorneys successfully argued for its enforcement, and the Kansas Court of Appeals agreed.  

The firm represented BP Corp. North America in an action by the City of Neodesha, which claimed underground pollutants from a closed oil refinery caused damage.  After the jury concluded the oil company was not obligated to do more than it was already doing, there were repeated efforts to obtain a new trial.  Ultimately, in 2014, the Kansas Court of Appeals held the jury’s decision should stand. 

In a 2018 decision before the Kansas Supreme Court, Central Kansas Medical Center v. Hatesohl, HFH successfully represented a doctor in a contract dispute with his former employer.
